Court declares Ebonyi Cybercrimes Law unconstitutional

A Federal High Court sitting in Abakaliki, on Tuesday declared the Ebonyi Cybercrimes Law No.12 of 2021 unconstitutional, null and void, even as it pointed out that the state lacks the power to legislate on cybercrimes.
The Court declaration followed a suit by one Pascal Etu who had sued the State Governor, David Umahi over the said law.
The state government had in September 2021 enacted the cybercrimes law before the House of Assembly members only, and there was no proof that the law went through public hearing before it became a law.
The public only became aware of the existence of such law when in October, a social critic, Godfrey Chikwere was arrested by the Police for allegedly flouting some sections of the law.The Police were about to charge him to court, when he suddenly slumped and was rushed to the hospital.
Earlier this year, Mr Etu was arrested for allegedly flouting the law, so also was the Spokesperson of the Peoples Democratic Party, (PDP) in the State, Chika Nwoba.
Both were remanded in prison by the State Magistrate Court pending the determination of the allegations against them.
Mr. Nwoba was later granted bail by the court following public outcry and condemnation that greeted his arrest.
Etu was not granted bail, as he is still in prison custody till date.
While the case against Mr. Etu was on at the State High Court, he instituted the matter against the State Government and four others at the Federal High Court in Abakaliki challenging the constitutionality of the law.
In the suit FCAI/CS/6/2022, Mr. Etu through his Lawyers prayed the court to declare that the Ebonyi State House of Assembly has no powers to make such laws.
He also argued that the “law is unconstitutional, null and void as it runs contrary to the Cybercrimes Act passed by the National Assembly.”
The respondents in the mater include Governor of Ebonyi State, Ebonyi State House of Assembly and the Attorney General of Ebonyi State as first, second and third respondents respectively.
Others are Commissioner of Police, Ebonyi State, and Department of State Security Services as fourth and fifth defendants.
In his ruling, The Presiding Judge, Justice Fatun Riman, granted all the prayers of the plaintiff.
The Judge while declaring the Ebonyi Cybercrimes Law 2021 unconstitutional, null and void also issued an order of injunction restraining the Ebonyi State Government from continuing to enforce the law.
Justice Riman, also held that the Ebonyi State House of Assembly had no constitutional powers to make such laws because the National Assembly had enacted the Cybercrimes Act in 2015, which is applicable in all the states of the federation.
The court also held that by virtue of cybercrimes being an item in the exclusive legislative list only the National Assembly can enact laws on it.
The court also set aside all steps, actions, proceedings howsoever taken by the Ebonyi State Government in furtherance of or in the implementation of the said Ebonyi Cybercrimes Law 2021.
Reacting, Mr. Etu’s Lawyer, Mike Odo, said that the Court, through the judgement had reaffirmed the constitutional right to fair hearing and freedom of expression of every individual.
He noted that people have the right to say what they want to say and push information to the general public within the ambit of the law.
He expressed confidence that with the judgement, the State High Court would free his client at the next adjourned date for the matter.

2027: NDC fixes October 20 for Campaign Council inauguration, Presentation of Certificates of Return

By Myke Uzendu, Abuja  The Nigeria Democratic Congress (NDC) has fixed October 20, 2026, for the inauguration of its Presidential Campaign Council (PCC), presentation of Certificates of Return to its candidates for the 2027 general elections and a strategic dinner for candidates contesting various elective positions.  The party also disclosed that its presidential and vice-presidential candidates, Peter Obi and Rabiu Musa Kwankwaso, respectively, would participate in consultations to determine key appointments in the campaign council.  National Chairman of the NDC, Senator Moses Cleopas Zuwoghe, announced this on Saturday at a press conference at the party’s national secretariat in Abuja.  He said the campaign council’s organisational structure and timetable had been ready since the end of August, but its inauguration was being delayed to allow Obi and Kwankwaso to conclude consultations and recommend nominees for strategic positions.  According to him, the activities scheduled for October 20 would follow a meeting of the party’s National Executive Committee (NEC), where key decisions concerning preparations for the 2027 elections are expected to be considered and ratified.  Cleopas said the delay did not indicate inactivity or internal division, explaining that the party was committed to establishing a properly constituted campaign structure capable of coordinating its nationwide electoral activities.  He added that appointments would reflect national spread, competence, capacity and the ability of nominees to contribute meaningfully to the campaign.  The NDC chairman disclosed that Obi and Kwankwaso were expected to recommend nominees for several strategic positions in the Presidential Campaign Council, including Director-General, Deputy Director-General, campaign spokesperson, Director of Social Media and Financial Controller.  The candidates are also expected to nominate two additional officers who, alongside the party’s National Treasurer, will oversee the campaign council’s separate and dedicated bank account.  Cleopas said the arrangement was intended to ensure that the presidential and vice-presidential candidates were actively involved in decisions affecting the organisation, financing and direction of their campaign.  He maintained that the party leadership, the candidates and the National Leader, Senator Henry Seriake Dickson, were united in their preparations for the 2027 elections.  The chairman said the campaign council would be formally announced after the national leadership received the candidates’ nominations and recommendations.  He argued that constituting the council without the active participation of the presidential candidate and his running mate would be inappropriate, given their central roles in the presidential contest. Cleopas also dismissed reports suggesting that the party was divided or struggling to organise itself ahead of the 2027 elections.  He said the press conference was partly convened to address concerns raised by party members, supporters and Nigerians over the apparent delay in establishing the presidential campaign structure.  The chairman maintained that the National Working Committee (NWC), NEC, National Leader and party structures at the state, local government and ward levels remained committed to the party’s candidates.  He equally rejected suggestions that Dickson was working with the ruling All Progressives Congress (APC) to undermine the NDC presidential ticket.  Questioning the basis of the allegation, Cleopas said it would have been easier for Dickson to join the APC than to undertake the more demanding process of establishing and registering a political party if his objective had been to work for the ruling party.  He urged journalists to exercise caution in reporting political allegations and speculation, warning that misinformation could create unnecessary distrust and mislead the electorate. ...
